1. ORDERING & PAYMENTList Item 1
Acceptance of Terms: An order is considered accepted when Sam Firewood confirms it in writing. By placing an order through any channel, you agree to be bound by these Terms and Conditions.
Pricing: All prices are in Canadian Dollars (CAD) and are subject to change based on seasonal availability, fuel costs, and delivery distance. Your quoted price is locked in at the time of order confirmation. Fuel surcharge may apply if diesel is over $1.80/liter. Quotations are valid for 7 days unless otherwise stated. Sam Firewood reserves the right to correct pricing errors prior to fulfillment.
Payment Methods & Terms: Payment is due at the time of delivery. We accept:
• Cash or Cheque
• E-transfer — funds must be sent and confirmed before the driver leaves the delivery site
Sam Firewood reserves the right to refuse service where payment cannot be confirmed at time of delivery.

2. DELIVERY & SITE ACCESSList Item 2
Delivery Scheduling: Delivery dates and time windows are estimates only. Sam Firewood is not liable for delays caused by weather, road conditions, traffic, equipment issues, or other circumstances beyond our reasonable control. We will make efforts to notify customers of significant delays.
Access Requirements: It is the customer's responsibility to ensure a clear, safe, and accessible path for our delivery vehicle. This includes:
• Removing vehicles, equipment, or obstacles from the delivery path
• Ensuring adequate overhead and width clearance for a dump truck
• Notifying Sam Firewood at time of booking of any constraints — narrow lanes, low branches, gates, or soft ground
• If driver is directed by customer to a spot where the truck gets stuck. Truck extraction, towing and Truck-on-Road fee costs will be billed directly to the customer
Failure to provide adequate access may result in cancellation of the delivery and a Truck-on-Road fee (see Section 3).
Driveway & Surface Policy: Drivers are instructed to operate only on paved, gravel, or firm hard-packed surfaces. Sam Firewood will NOT drive delivery vehicles on:
• Lawns or soft ground
• Areas over septic tanks, weeping tile, or buried utilities
• Any surface that the driver, in their sole judgment, deems unsafe
If the only access to the requested drop location requires traversing any of the above, wood will be deposited at the nearest safe and accessible point.
Wood Placement: Sam Firewood provides dump delivery. Wood is deposited at the most practical accessible location based on site conditions. We do not stack, split, or relocate wood after delivery. Specific placement requests are accommodated where safe and feasible, but cannot be guaranteed.

3. CANCELLATIONS & FEESList Item 3
Cancellation Notice: Customers must provide a minimum of 24 hours' notice to cancel or reschedule without penalty. Cancellations can be made by phone, text, or email.
Late Cancellation & No-Show Fee: A $150.00 CAD per hour Truck-on-Road Fee may be charged in the following circumstances:
• Cancellation made less than 24 hours before the scheduled delivery window
• No one is available at the delivery location and access cannot be completed
• The site is inaccessible due to conditions not disclosed at time of booking
• This fee covers fuel, labor, production standstill and vehicle costs incurred once a truck has been dispatched.

4. PRODUCT DESCRIPTION & NATURAL VARIATIONList Item 4
Firewood as a Natural Product: Firewood is a natural, unprocessed resource. Customers acknowledge and accept that:
• Individual logs vary in size, shape, length, and density
• Each load is unique; no two deliveries are identical
• Loads may contain a small percentage of bark, wood chips, or split irregularities
• Wood is measured and sold by face cord or full cord; slight variations in stacking density are inherent to the product
Moisture Content & Seasoning: Sam Firewood strives to supply well-seasoned hardwood. However, customers acknowledge that:
• Surface moisture may occur due to rain or snow during transit or storage
• Moisture content cannot be guaranteed to a specific percentage
• It is the customer's responsibility to stack and store firewood in a dry, well-ventilated location
• Wood stored improperly (e.g., on bare ground or without airflow) may develop mold or deteriorate
Insects, Organisms & Invasive Species: As a natural product, firewood may contain insects, larvae, surface mold, or other naturally occurring organisms. By accepting delivery, customers acknowledge that:
• Sam Firewood is not liable for issues arising from storage of firewood near or inside a residence
• Customers are responsible for compliance with any local regulations regarding firewood transport or invasive species

5. PROPERTY & LIABILITY
Property Damage Disclaimer: By directing or permitting Sam Firewood's driver onto your property, you voluntarily assume all risk for any resulting property damage, including but not limited to:
• Cracking, rutting, or staining of driveways and pathways
• Damage to curbs, landscaping, or lawns
• Damage to underground utilities, septic systems, or irrigation lines not clearly marked or disclosed at time of booking
Sam Firewood is not liable for property damage arising from delivery vehicle operation when access was granted by the customer or authorized representative.
Note: Customers are strongly encouraged to mark the locations of buried utilities, septic tanks, and irrigation systems prior to delivery. Sam Firewood drivers will exercise reasonable care at all times.
Limitation of Liability: To the fullest extent permitted by applicable law, Sam Firewood's total liability for any claim shall not exceed the amount paid for the specific delivery in question. Sam Firewood is not liable for indirect, incidental, or consequential damages of any kind.
Safety During Delivery: Customers, children, and pets must remain at a safe distance from the delivery vehicle during tipping and unloading. Sam Firewood is not liable for personal injury to any person who enters the active unloading area during delivery.

6. RETURNS, COMPLAINTS & PICK UP
Complaint duration: Any concern regarding wood quality or quantity must be reported within 48 hours of delivery.
Final Sale: Due to the high cost of transport and the nature of the product, all sales are final once the wood has been dropped at your location. We do not offer returns or pickups of delivered wood.
Pick Up: Customers who choose to pick up firewood from our wood yard do so at their own discretion and risk. SAM Firewood is not responsible for any damage, loss, or injury to customer vehicles, trailers, equipment, or personal property while accessing, loading, or leaving the wood yard. Customers are responsible for ensuring their vehicle or trailer is suitable for transporting firewood safely.

7. WEBSITE & COMMUNICATIONS
Accuracy of Information: Sam Firewood makes reasonable efforts to ensure that product descriptions, pricing, and availability information are accurate. We reserve the right to correct errors at any time.
Terms Cited in Quotations: Quotations and communications from Sam Firewood may include a link to these Terms and Conditions. By proceeding with a purchase after receiving a quotation, you confirm acceptance of these Terms as published on our website at the time of your order.
Privacy & data: Sam Firewood collects customer contact and delivery information solely for the purpose of processing orders and communicating about deliveries. We do not sell or share personal information with third parties except as required to fulfill your order. Our practices are consistent with applicable Canadian privacy legislation (PIPEDA). Governing law: These Terms and Conditions are governed by the laws of the Province of Nova Scotia and applicable laws of Canada. Any disputes that cannot be resolved informally shall be subject to the exclusive jurisdiction of the courts of Nova Scotia.
Amendments: Sam Firewood reserves the right to update or modify these Terms and Conditions at any time without prior notice. The current version and any updates will always be available at www.samfirewood.ca. Continued use of our services after any update constitutes acceptance of the revised Terms.
